In EB-5 cases, there is no fixed maximum number of RFEs (Request for Evidence). The USCIS may issue as many evidence requests as it deems necessary to evaluate a case, and receiving more than one does not mean the petition is doomed.

Each RFE typically focuses on a specific aspect of the petition, such as proof of the lawful source of funds, the viability of the project, or the documentation supporting the investment. Responding thoroughly and in an organized manner gives the adjudicator the elements needed to reach a well-supported decision.

A higher number of RFEs may simply reflect the need for additional clarification, not an automatic denial. Transparency, consistency across documents, and precision in responses are what sustain a solid case.
