As a general rule, there is no automatic annual revalidation of unemployment data for an area already designated as a TEA (Targeted Employment Area) under EB-5. The designation relies on the statistical data available at the time of evaluation.

That data comes from official statistical sources, such as the Census Bureau and the Bureau of Labor Statistics, and may be updated as new information is released. This does not mean, however, that each area undergoes an automatic reanalysis every year.

Reassessments or updates tend to occur when there are meaningful changes in the region’s economic indicators, or when the competent authority determines that a review is warranted, always with the aim of reflecting the current state of the labor market.

  • TEA qualification is based on the data in effect at the time of evaluation.
  • There is no guaranteed automatic annual review established by regulation.
  • Economic changes or decisions by the authority may prompt a reassessment.

Because rules and data can change, follow official publications and confirm the current requirements with USCIS or a qualified specialist before making decisions about your project.
