Not in the way many people imagine. EB-5 is a program regulated at the federal level, so no state can ‘facilitate’ licenses, provide direct visa subsidies, or approve the benefit on its own.

What actually happens in practice is different. Many EB-5 projects are structured through regional centers and, in that format, may benefit from incentives, partnerships, and specific rules from state or local governments. These initiatives typically serve to direct investment toward areas that need economic development, which can make a project more attractive.

Even so, that is not the same as EB-5 approval itself. The review of the qualifying investment and job creation that supports a visa petition is based on federal criteria, not state criteria.

That is why, when evaluating a project, it is worth verifying updated requirements with USCIS, checking the track record of the venture, and being cautious about promises of special facilitation or guaranteed outcomes.
