Once the removal of conditions petition is approved, the EB-5 investor moves from conditional permanent resident status to full, unconditional permanent resident status. This status carries no automatic expiration date: in practical terms, it remains in effect as long as the holder meets the duties of a permanent resident.
That said, permanent resident status is not absolutely permanent or irrevocable. It can be lost in situations such as abandonment of domicile in the United States, failure to comply with immigration laws, or other violations that the authorities consider relevant.
It helps to distinguish two things that are often confused:
- The status of permanent resident, which does not expire simply with the passage of time.
- The physical card (the green card itself), which has a printed expiration date and must be renewed periodically, without affecting the underlying status.
