What is the difference between RFE and NOID?

It is common to encounter technical terms during the immigration process, especially in categories such as the EB-2 NIW.

Two terms that may cause doubts are RFE (Request for Evidence) and NOID (Notice of Intent to Deny). Each of them has a distinct role within the petition review procedure.

An RFE is a request for additional evidence to strengthen or clarify the petition, and does not mean an immediate denial. A NOID indicates the USCIS’s formal intention to deny the case, pointing out unresolved issues, but still allows a response within a stipulated period.
