Is an interview always required in the EB-2 NIW process?

In the EB-2 NIW process, an interview is not a mandatory step in every case. Many petitions are decided based solely on the submitted documentation, and USCIS may waive the interview when the body of evidence is clear and consistent.

This does not mean an interview will never happen. One may be scheduled when an officer has questions about the information provided, finds inconsistencies between documents, or identifies points that require additional clarification. In those situations, the interview serves to complement the review, not to replace it.

Since each petition is evaluated individually, there is no way to guarantee in advance whether an interview will be required. What is within your control is the quality of your petition package:

• Documentation that is organized, coherent, and easy to follow.
• Consistent information across forms and the evidence submitted.
