The EB-2 NIW visa, once approved, grants the beneficiary permanent resident status in the United States. This means that once the petition is approved and the adjustment of status (or consular process) is completed, the individual becomes a permanent resident – commonly known as a ‘green card’ holder.

It is important, however, to understand that the green card, although it confers the right to live and work in the country permanently, is not a ‘forever’ document without the need for maintenance.

In practice, the permanent resident status is lifelong, provided that the holder meets the requirements established by immigration laws.
