The EB-1C is the path for executives and managers of a multinational company being transferred to its U.S. operations. It is built around a qualifying period of managerial or executive experience abroad, in a role compatible with the one to be held in the United States. Team size alone does not determine anything.

Managing a group of researchers and interns may contribute to your experience, but what the analysis looks for is the substance of the role: did you have authority to make strategic decisions, set goals, and guide the direction of the department, or did you mainly oversee day-to-day tasks?

  • The complexity and scope of the responsibilities held.
  • The degree of autonomy in decision-making, not just supervision of people.
  • Your position in the hierarchy and the relationship to the role in the U.S.

In addition, both companies must have a corporate relationship that supports the transfer. Since the required period and the classification are evaluated on a case-by-case basis, it is worth checking the updated requirements with USCIS and assembling the documentation with a specialist.
