The waiver of the job offer requirement – through the NIW – makes the application more flexible, but the process requires strong evidence of the positive impact of the professional activity.

Therefore, stating that the E-2 is an ‘alternative’ to the EB-2 NIW would not be entirely accurate. Each visa has specific purposes: the E-2 is ideal for investors who seek to operate a business while maintaining temporary status, and the EB-2 NIW is directed to professionals who want to immigrate permanently, contributing significantly to the economy or areas of interest in the United States.

Regardless of the choice, it is essential to strictly follow United States immigration laws and seek guidance from reliable and specialized sources, avoiding scams and miracle promises circulating in marketing campaigns. Each profile and situation demands careful analysis of the requirements and possibilities, and informed decisions are fundamental for a safe and successful process.
